Terms & Conditions

1. Definitions

  1. "Conditions" means these terms and conditions along with our Returns Policy;
  2. "Contract" means the Order and Order Confirmation (incorporating any Special Conditions);
  3. "Goods" means the goods which we are to sell in accordance with these Conditions;
  4. "Member" or "you", "your" means any person who has been accepted for membership of achica and any payment tendered by or on behalf of such Member with any order shall be deemed to be with the permission or consent of the Member;
  5. "Price" means the price at which we have agreed to accept the Member's order and any applicable VAT;
  6. "we" "us", or "our" means BrandAlley UK Limited ;
  7. "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided;
  8. "Special Conditions" means the terms and conditions in the Product Description;
  9. "Personal Information" means the details provided by you on registration for membership of achica as amended from time to time;
  10. "Website" means the website located at or any subsequent URL which may replace it;
  11. "Cookies" means small text files which our Website places on your computer's hard drive to store information about your membership and any shopping session and to identify your computer;
  12. "Order" means the order for Goods placed by a Member using the Website; and
  13. "Order Confirmation" means the confirmation sent by email from us to you confirming an Order.

2. Formation of Agreement

  1. This use of the Website and the purchase of any goods from the Website is governed by these Conditions
  2. We reserve the right to modify these Conditions without notice to you.
  3. Buyers must be over the age of 16 years old and have full legal capacity unless Special Conditions apply

3. Registration

  1. To access the Website, you have to complete the online registration form to become a Member of the site.
  2. All Personal Information collected will be used in accordance with our Privacy Policy.
  3. By registering with the Website, you are accepting these Conditions.
  4. By registering with the Website, you are giving consent for achica to email you with daily offers. You can unsubscribe from these emails at any time.

4. Orders & Product Descriptions

  1. All Orders must be placed through the Website.
  2. Our display of Goods on the Website is an invitation to treat. Your submission of an Order represents an offer to purchase the Goods indicated by you and it is not binding on us until we have notified you that an Order is accepted by sending you an Order Confirmation.
  3. achica complies in full with all relevant consumer regulations. We will attempt to deliver Orders within timescales set out in the Product Description. If this time period is exceeded for any reason, we will notify you by email of this delay and give you the option of cancelling your Order. Please note this guarantee does not apply for Orders where delivery has been attempted and our courier has been unable to make the delivery.
  4. All Goods are offered for sale subject to availability and subject to our acceptance of the Order. In the event that any Goods ordered are out of stock, we will endeavour to inform you as soon as we are made aware by our supplier. The Order relating to the unavailable Goods will be cancelled and a full refund will be applied.
  5. All Product Descriptions related to Goods which contain any descriptions, specifications, drawings or prices of the Goods are published or submitted for guidance only. However, we are under a legal duty to supply Goods which are in conformity with the Contract and therefore, we reserve the right to make minor modifications to the design and specification of the Goods without notice to you, but agree to notify you of any major or material modifications.
  6. Restricted Items: It is against the law to sell or supply intoxicating substances, such as alcohol, or to sell any knife, knife blades or razor blades to persons under the age of 18 years of age in the UK, the Republic of Ireland or the Channel Islands. By placing your Order on these items with Special Conditions, you confirm that you are at least 18 years of age. We may contact you via telephone to verify your age, or if we require documentation to support the purchase and we will require a valid identification, such as a driving licence, passport or birth certificate to be sent to us. Should we deem that the identification is not valid or identification cannot be provided for the purchase, we may cancel the Order. The courier delivering such an order may request identification at the point of delivery to verify your age. Where such identification cannot be provided or the courier is not satisfied with the age of the recipient, the courier may retain the delivery.

5. Payment & Prices

  • All Goods are exclusive of delivery charges, which will be indicated to you during the ordering process.
  • We reserve the right to modify our prices at any time.
  • Card payments will be processed by Barclaycard Smartpay, PayPal or other payment processor.
  • Any refunds will be made to the card or PayPal account used in the Order within 14 days of receipt by us of any returned Goods. To comply with audit standards, the card or account details used for refunding an Order cannot be amended.
  • Fraud checks may be conducted on our Orders. This involves checks on details provided during the ordering process including the address details. This may involve your details being passed to a 3rd party fraud checking company. On occasion we may ask for additional information in order to process your Order. We will conduct this process as quickly as possible however on occasion dispatch of Goods may be delayed. We reserve the right to cancel any order.
  • The Price is that price displayed on the Website at the time we receive your Order. While we try and ensure that all Prices on our Website are accurate, errors may occur. If we discover an error in the Price of Goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your Order at the correct Price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel and you have already paid for the Goods, you will receive a full refund.

6. Delivery & Returns

  1. You have the right under relevant consumer regulations to cancel your Order within 14 days from the day after you take physical possession of the Goods. If you purchase several different Goods in one Order and they are delivered at different times, you may cancel your Order for any or all of the Goods within 14 days of the day after the last item of Goods in your Order came into your physical possession.
  2. If you wish, you may cancel your Order by sending us the model cancellation (provided under Part B of Schedule 3 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013).
  3. achica is a specialist online retailer whose sales are limited in terms of time and stock and all Orders are subject to availability. Due to the nature of our business, we may not have the Goods in stock. Instead, we would have reserved the Goods with our supplier for the duration of the sale and only ordered it from our supplier at the end of the sale and therefore we may have to wait to receive Goods from our suppliers. Consequently, whilst we endeavour to dispatch Goods within the indicated dates, Orders may sometimes take longer and we will advise you of the status where applicable.
  4. Delivery dates outlined in the Product Description are an estimate only. By agreeing to these Conditions you accept that we may not be able to deliver the Goods within the estimate. You hereby agree that the statutory 30-day delivery period does not apply to the Contract.
  5. Should you order Goods from one or more sale, your order may be collated by our warehouse once all Goods are available. We reserve the right to make delivery of the Goods by instalments.
  6. All Goods will be delivered to your registered address or, where requested by you as part of the Order, to another address selected for that particular Order. It is your responsibility to give us the full and correct delivery address details. We are not able to deliver to PO Box numbers and cannot receive amendments to the delivery address once the Order is dispatched.
  7. If you are not present at the time of delivery, a delivery note will be left, stating that the courier will re-attempt delivery the following day, or that the Goods have been left in a secure location outside of the property or with a neighbour. If this is not possible, the Goods will be returned to the courier delivery depot and the driver will attempt to deliver the Goods another time. If the Goods have been returned to the courier depot after three attempts, then the Goods will be returned to our warehouse. The Goods will automatically be returned to achica as undeliverable. We are unable to resend Goods that are returned to us as undeliverable. In that case, we will refund you the value of the Goods ordered.
  8. You must inspect the Goods on delivery and, in the case where Goods have been delivered by carrier, sign the required proof of delivery document or collection acceptance document. A signature on that document will constitute conclusive evidence of receipt by you of the quantity of Goods indicated on that document free from any apparent defect or damage. Any delivery problem with the Goods should be notified to achica’s Customer Care team, within fourteen days of receipt.
  9. Please return any incorrect or defective Goods to achica as soon as possible. Due to its supply process, achica is unable to provide replacements for incorrect or defective Goods or undertake repairs. Subject to a full investigation by us with our supplier and with the courier, achica will provide a full refund for defective, incorrect or missing Goods (return postal charges will only be refunded where the Goods have been found to be wrongly described or defective). This does not affect your statutory cancellation rights.
  10. If any Goods are to be returned, you must return the Goods in good condition, unused and with their original packaging or packaging of an equivalent standard, ensuring that the product is packed well enough to avoid any damage. Please take reasonable care of the goods, we are entitled to deduct an amount from the refund to reflect any loss in value of the goods supplied, if the loss is the result of unnecessary handling of the goods by you. We reserve the right to reduce a refund on any Goods that are incomplete, damaged or dirtied up to a value of 100% of the Price. Please include with any return of Goods the model cancellation form or the returns form enclosed with the Goods so that achica can identify your Order. Should you fail to return the Goods to the return address provided, achica will not be held responsible for any delays to refunds or postage issues.
  11. Your refund will be processed within fourteen days of our warehouse receiving your Goods and will include a refund of our standard outgoing delivery charge.
  12. Other than for defective products, returns outside the timeframe set out above may be accepted at the sole discretion of achica and may be refunded as a credit to be spent online. Any unauthorised returns will be refused.
  13. Cost of returns: you will incur the cost of returns unless (i). the product received is incorrect, or (ii). deemed damaged or faulty – photographic evidence will be required.
  14. Due to hygiene or safety reasons, the following items are non-returnable and non-refundable:
    • Perishable goods such as food and flowers
    • Incomplete cases of wine
    • Pierced jewellery
    • Cosmetics/fragrance once the original packaging has been opened
    • Magazine subscriptions
    • Underwear, hosiery or swimwear without hygiene strips
    • Items that have been personalised for you, such as gifts or stationery
    • Made to measure products such as furniture and fabric cut by length.
  15. Lost Returns: Should your chosen courier fail to deliver or lose any Goods you are returning it is your responsibility to claim compensation from the courier directly. achica is not liable for any lost return parcels of Goods.
  16. achica will not be liable for any loss or expenses sustained by you arising from any delay in the delivery of the Goods howsoever caused.

7. Vouchers

  1. You may occasionally receive vouchers from achica.
  2. Unless otherwise stated, vouchers can only be used once and exclude travel deals.
  3. Only one discount code can be used per order.
  4. No cash alternative available.
  5. Only one voucher is eligible per household.
  6. Vouchers are valid until the specified date, or till the 31st December of the current year (if no date is specified).
  7. achica reserves the right not to issue discounts or remove them where we have grounds to suspect the promotion has been used in contravention of the Conditions. achica reserves the right to withdraw, amend or extend a voucher code promotion at any time. Other terms may apply, please see the specific promotion terms for full details.
  8. A voucher is only applicable to the email address it was sent to and is not transferable.
  9. Vouchers are valid on the achica Website only.
  10. Should you cancel or return Goods from an order where a promotional discount code has been used, no refund of this promotional code or equivalent value will be provided.
  11. Vouchers cannot be split into smaller values and any remaining amount left on a discount code or voucher after a purchase cannot be retained.
  12. Some vouchers may specify a minimum spend in order to be used. In this case, the monetary value of the order (excluding delivery charges) has to be equal to, or higher than, the minimum spend specified.
  13. Invite a friend promotion. The customer will automatically receive a £10 voucher for every new Member friend they refer to achica that subsequently registers and makes an Order online. There is no limit to the number of friends a customer can invite. The friend will receive their voucher on dispatch of their first purchase. We reserve the right not to issue vouchers or remove them where we have grounds to suspect there has been an abuse of the referral scheme.

8. E-mail, user name and password

  1. The user name and password you are issued with, before you can order Goods from us, are personal to you and are not transferable.
  2. Any breach or suspected breach of security of a user name and password should be notified to us immediately. You will be responsible for any payments due for Goods ordered through the Website by anyone using your user name and password.
  3. We guarantee the confidentiality of any data Personal Information transmitted to us after you have entered your password. You are responsible for the use of your password and maintaining its confidentiality.

9. Intellectual property

  1. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us. You are permitted to use this material only as expressly authorised by us.
  2. You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited.

10. Third party links

  1. To provide increased value to our Members, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
  2. We use Cookies to keep track of your current shopping session to personalise your experience and so that you may retrieve your shopping basket at any time - if you do not accept Cookies you will be unable to use this Website.

11. General

  1. These Conditions shall be governed by and construed in accordance with English law. Any disputes shall be subject to the exclusive jurisdiction of the English courts, to which both parties submit.
  2. You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.
  3. We will not be liable in any way for loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing any obligation under this Contract by reason of any event or circumstance outside the our reasonable control, including but not limited to, any strikes, industrial action, failure of power supplies or equipment, government action or Act of God. Nothing in this Condition shall limit or exclude our liability for death or personal injury caused by our negligence, or any other warranties or conditions that cannot be excluded under the law. We will not be liable to the Member for any indirect or consequential loss or damage, costs, expenses (including loss of profit) or other claims for compensation whatsoever arising out of or in connection with the sale of the Goods or their use or resale by the Member.
  4. Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
  5. If you have made a complaint and have exhausted all the options provided by achica, or you are not satisfied with the resolution we have provided, you have the right to refer your dispute to Alternative Dispute Resolution.
